GTCs
The following are the general terms and conditions of DieMaGro e.K. for renting game modules with controllable model cars. By accepting the offer, you agree to these general terms and conditions.
Scope of application
Offers, services and invoicing are carried out exclusively on the basis of these general terms and conditions of DieMaGro e.K. Mobile Racing Events. Conflicting terms and conditions of the client are only valid if they are accepted by DieMaGro e.K. in writing. Agreements deviating from or supplementing these general terms and conditions must be made in writing. If any provision of these "general terms and conditions" is not valid, this shall not affect the validity of the remaining provisions and the contracts concluded based on them. The ineffective provision shall be replaced by one that comes closest in sense and purpose.
Offer and contract conclusion
The offers of DieMaGro e.K. Mobile Racing Events are non-binding. A contract is only concluded by a written order confirmation and is based exclusively on its content and the current GTCs. The client accepts these terms and the terms of payment when placing the order.
Service provision / Operation of the game modules
DieMaGro e.K. will set up and dismantle the game modules and/or the racetrack trailer on level grounds, and will provide support and supervision during the entire event. When conducting events with only one employee of DieMaGro e.K., the organiser/customer must provide a second person for the entire assignment (help with setting up and dismantling and while conducting the event). Setting up and dismantling will be undertaken outside the agreed event time. There must be enough space for the corresponding game modules, especially for the racetrack trailer. The organiser/customer must provide sufficient parking facilities for DieMaGro e.K. vehicles. The event site must be freely accessible for the company vehicles for set up and dismantling before and after the agreed event time.
Operating requirement
A power connection (230 V / 16 A) is required at a maximum distance of 25 m. Consumption costs will be borne by the organiser/customer. In adverse weather conditions (storm, thunderstorm), outdoor operation of the racecourse and the other modules must be stopped for safety reasons.
Insurance and liability
The organiser/customer is solely liable for personal injury and material damage during an event. DieMaGro e.K. is only liable within the legal framework; any further liability is excluded. The organiser/customer is fully liable for damages, destruction, theft and the resulting consequential and breakdown costs. The same applies to accidents that occur in the area of responsibility of the organiser/customer. If DieMaGro e.K. cannot provide the agreed services due to exceptional circumstances and external influences (force majeure, natural disasters, official orders, disruptions to the organiser/customer, power failures or power fluctuations, etc.), the organiser/customer has no right to withdraw from the contract, no claim to damages, and no right to withhold payment. Even if the event modules are operated by DieMaGro e.K., the customer remains the legal organiser.
Withdrawal from the contract/booking
The client is entitled to terminate the contractual relationship with DIeMaGro e.K. at any time. However, early termination of the contractual relationship obliges the client to pay the agreed invoice amounts or advance services already rendered according to the following scale: Cancellation up to 30 days before the event: 30% of the agreed total amount Cancellation up to 21 days before the event: 50% of the agreed total amount Cancellation up to 14 days before the event: 100% of the agreed total amount
Cancellation of the contract or booking must be made in writing.
The right to extraordinary termination for both contracting parties remains unaffected. In particular, DieMaGro e.K. is entitled to this right if the agreed invoice amounts have not been paid by the client at the due date.
Payments
Payments are to be made directly to DieMaGro e.K. without deduction and exclusively. The following payment methods are accepted: a) Cash payment before/during or at the immediate end of an event. b) Bank transfer to an account specified by DieMaGro e.K. immediately after receipt of the invoice, but no later than 7 working days after receipt of the invoice. If a down payment (20% or 50%) has been agreed upon placing the order, it must be received within 5 working days after placing the order in the designated account. The event date remains reserved.
General provisions
If registrations for the event are required or permits must be obtained from public authorities (Ordungsamt, GEMA, etc.), this is will be the client's responsibility. DieMaGro e.K. Mobile Racing Events is entitled to take pictures during an event and to use them with the client's name for reference purposes.
All quoted prices exclude VAT.
The place of legal jurisdiction is Neuss, Germany.
